{"id":2464,"date":"2023-08-09T13:46:13","date_gmt":"2023-08-09T13:46:13","guid":{"rendered":"http:\/\/www.robbtax.co.uk\/blog\/?p=2464"},"modified":"2023-08-09T13:46:27","modified_gmt":"2023-08-09T13:46:27","slug":"understanding-tax-obligations-for-charities","status":"publish","type":"post","link":"https:\/\/www.robbtax.co.uk\/blog\/understanding-tax-obligations-for-charities\/","title":{"rendered":"Understanding tax obligations for charities"},"content":{"rendered":"<p>Knowing your charity\u2019s obligations to HM Revenue &amp; Customs (HMRC) is important, as you will have different requirements to standard businesses.<\/p>\n<p><!--more--><\/p>\n<p>Whilst charities are not exempt from tax entirely, they do have certain reliefs that charities can benefit from.<\/p>\n<p><strong>Claiming tax relief<\/strong><\/p>\n<p>For your charity to be eligible for tax relief, it must be:<\/p>\n<ul>\n<li>Based in the UK<\/li>\n<li>Established for charitable purposes only<\/li>\n<li>Registered with the Charity Commission or another regulator<\/li>\n<li>Recognised by HMRC.<\/li>\n<\/ul>\n<p>To be officially registered as a charity with HMRC, you will need the charity\u2019s bank account details, registration number, objectives, officials\u2019 details, governing documents, and the Government Gateway user ID.<\/p>\n<p><strong>Paying tax<\/strong><\/p>\n<p>If your charity has income that does not apply for tax relief, then you must complete a Company Tax Return form.<\/p>\n<p>If you have no tax to pay at all, then you will only need to complete a tax return if HMRC asks you to do.<\/p>\n<p>It should be noted though that if your charity\u2019s income is over \u00a310,000 per year, then you will need to submit an annual return to the Charity Commission.<\/p>\n<p><strong>What\u2019s included in charity tax relief?<\/strong><\/p>\n<p>Charities will be exempt from paying tax on a number of goods and services so long as they are using the money for charitable purposes.<\/p>\n<p>Examples of qualifying income for tax relief include:<\/p>\n<ul>\n<li>Donations<\/li>\n<li>Profits from trading (such as a charity bookshop or charity caf\u00e9)<\/li>\n<li>Rental or investment income (bank interest)<\/li>\n<li>Profits when you dispose of an asset<\/li>\n<li>When buying property<\/li>\n<\/ul>\n<p>However, charities must still pay tax on dividends received from UK companies before 6 April 2016, profits from developing land or property, and purchases.<\/p>\n<p>It should be noted that when charities dispose of land (including selling or leasing land), they must abide by the regulations in the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2022\/6\/contents\/enacted\">Charities Act 2022<\/a>.<\/p>\n<p><strong>Types of VAT relief<\/strong><\/p>\n<p>VAT relief is available for charities on fuel and power for things such as residential accommodation (children\u2019s home or care home), charitable non-business activities such as free daycare for disabled people, and small-scale use (up to 1,000 kilowatt hours of electricity a month or up to 2,300 litres of gas oil).<\/p>\n<p>Here, VAT will only be at five per cent instead of the usual 20 per cent.<\/p>\n<p>There is also a zero rate VAT relief for charities, which includes a wider array of items and services including advertising and items for collecting donations, drugs, chemicals and medicines, and construction services to name a few.
